The Myriad and Prometheus decisions bring new precedence governing the ability to patent DNA or other laws of nature. Of course, the effects of these rulings will only be a factor in the U.S., but they will affect the way patent applications should be drafted and filed in foreign countries, as well as during the PCT phase.

These applications will require a little more coordination while being drafted, but these efforts will pay dividends once the applications enter the U.S. examination period. The full impact of these decisions is not yet known, but being proactive is the best general advice we can provide. In general, we know that DNA claims will not be allowed, and that methods relying on a natural law will need to do more than apply the natural law.
