How to Improve Quality and Reduce Legal Risk Using the National PSQIA Privilege

Health systems around the country are using the national PSQIA privilege and confidentiality protections to make transformational advances in the quality of patient care. The Patient Safety and Quality Improvement Act (PSQIA) was passed to break the silos resulting from state peer review statutes by establishing a national privilege. The national privilege is stronger than any state peer review privilege and permits hospitals to solve their own problems and communicate across state lines insulated from liability and reputational harm. Learn how to use the national PSQIA privilege to "systemize" quality improvement of patient care, achieve specific quality improvement goals, and reduce health care costs, including malpractice operational costs. We will also discuss the growing body of case law that analyzes the national PSQIA privilege, and the impact of such case law on legal challenges to the privilege.

Specifically, by attending this seminar you will learn:

  • What the national PSQIA privilege is and how it works;
  • What is required under the Affordable Care Act beginning on January 1, 2015, for a qualified health plan to contract with a hospital housing more than fifty beds;
  • What documentation is necessary to maintain the national PSQIA privilege;
  • How can you break the silos and use the national PSQIA privilege to transform patient care; and
  • What we can learn from the current case law challenging the national PSQIA privilege?
