Health Care Providers Prepare for the NLRB's Perfect Storm – Quickie Elections and Micro Bargaining Units

Wednesday, March 18, 2015

12:00 PM - 1:15 PM (Central)

On April 14, 2015, the National Labor Relations Board ("NLRB") will be implementing a rule to dramatically speed up Union elections, reducing the waiting period between an election petition's filing and the vote itself (in many cases from 2-3 months to 2-3 weeks). If implemented, the "quickie election rule" (or "ambush election rule") will cause employers to lose most of their opportunity to educate themselves and their employees as to the effects of unionization. With high employee head counts across multiple shifts, medical providers could be among the organizations most impacted by this change.

Combined with the NLRB's recent policies and decisions which allow Unions to represent micro-bargaining units, at times consisting of a few employees on a given shift, it is more important than ever for health care providers to be prepared for possible Union organizing campaigns. Polsinelli attorneys will discuss how waiting until a representation petition is filed can place an employer at a significant disadvantage, and provide best practices to prepare for a potentially unsettled future in labor relations.

Additional topics of discussion:

  • A brief history leading up to the new "ambush election rule", scheduled for implementation next month
  • A review of the NLRB's Specialty Healthcare decision pertaining to micro-bargaining units: how it has been interpreted over the past few years, and the outlook for the future
  • The "doomsday" scenario of a "quickie election" in a non-traditional bargaining unit consisting of only a few employees on one particular shift or floor, and how it could play out
  • Tips on how employers can prepare themselves now for a Union organizing campaign

  • Robert E. Entin, Shareholder, Polsinelli
  • Scott M. Gilbert, Shareholder, Polsinelli
  • Mark D. Nelson, Shareholder, Polsinelli

Robert E. Entin, Shareholder | Polsinelli

Rob Entin is not your ordinary labor and employment attorney. Before joining Polsinelli, Rob worked as an in-house counsel for a large Chicago-area labor union. That unique work experience has helped clients in the defense of unfair labor practice charges, representation at arbitrations, and bargaining over collective bargaining agreements. Working for the "other side" enables him to explain the motivation and desires of unions and the employees they represent, and this insight facilitates creative solutions for many complex and sensitive workplace issues. A labor and employment generalist, Rob also assists clients with counsel on employee discipline, hiring and firing, defending discrimination charges in state and federal court, oversight of employee handbooks and workplace safety investigations.
